In Virginia, laws concerning divorce, division of property including retirement benefits, and spousal support are complex and there are pitfalls to avoid—particularly regarding the “reservation of support” and the “marital share” of retirement.
In addition, there are numerous factors the court must consider before awarding spousal support. These factors include the length of the marriage, whether “fault” was involved, and the relative health, ages, education levels, and employment history of each spouse.
